MORTGAGE MODIFICATION

Is a process inside a chapter 13 bankruptcy where the terms of a mortgage are modified usually to bring a mortgage current. The modification changes the original terms of the contract agreed to by the lender and borrower. In general, any loan can be modified, and the process is referred to as loan modification or debt reorganization.

IRS DEBT

In certain circumstances IRS Debt can be discharged in a bankruptcy. In other words, if certain conditions exist the debt may be eliminated or if it cannot be discharged then it may be paid back over up to a five year term without interest or penalties.

GARNISHMENTS

Is a legal process for collecting a monetary judgment on behalf of a plaintiff from a defendant / debtor. Garnishment allows the plaintiff (creditor) to take the money or property of the debtor from the person or institution that holds that property. Bankruptcy may, in most circumstances, stop the garnishment.

CAR REPOSSESSION

Chances are you rely on your vehicle to get you where you need to go. But if you’re late with your car payments, or in some states, if you don’t have adequate auto insurance, your vehicle could be taken away from you. In most instances the filing of a bankruptcy may protect your car and allow you to repay the debt under more favorable terms.

PROTECT YOUR ASSETS

Chapter 13 bankruptcy may help you.  Chapter 13 is a reorganization, a payment plan of up to five years under court supervision that allows a debtor to bring his mortgage current.

In some cases a debtors property may be at risk  of being seized by creditors. Chapter 13 may be able to protect these assets from your creditors
